H.R. 373 — SAGA Act

This section amends the savings clause of federal firearms law (18 U.S.C. §927)—which preserves state authority absent a direct conflict with federal law—by (1) designating the existing text as subsection (a) with an exception for subsection (b); and (2) adding subsection (b) to prohibit a state or political subdivision from imposing any regulation, prohibition, registration or licensing requirement, penalty, tax, fee, or charge with respect to the design, manufacture, importation, sale, transfer, possession, or marking of a rifle or shotgun (including any part, detachable magazine or ammunition feeding device, pistol grip, or stock design) that has moved in or affects interstate or foreign commerce if more restrictive or greater than under federal law. To the extent such a state or local law violates this prohibition, it has no force or effect, and a prevailing plaintiff in an enforcement action is entitled to reasonable attorney's fees in addition to other relief.
