H.R. 3738 — HMAG Act of 2025

This section amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act to add a new section 431 authorizing the President, acting through the FEMA regional administrator, to provide assistance—including grants, equipment, supplies, and personnel—to state or local governments for mitigating and managing extreme heat events. Assistance requires coordination with NOAA; eligibility based on state or local government submission of assessments on potential loss of life and revenue (drawing from prior events), other available aid sources, and long-term impacts (including to infrastructure); and may incorporate essential assistance authorities under section 403 or hazard mitigation assistance under section 404, even absent a major disaster declaration. The President must issue regulations specifying required agreements, an appeals process for denials, and eligible costs. Separately, within 90 days of enactment, the FEMA administrator, jointly with the NOAA administrator and consulting the CDC director, must develop a temperature and duration threshold defining an extreme heat event for purposes of this authority.
