H.R. 3746 — Rebuilding America’s Airport Infrastructure Act

This section increases the maximum passenger facility charge (PFC) that eligible public agencies operating commercial service airports may impose with FAA approval—from up to $4.50 to a phased schedule of $5.50 for calendar year 2027, $6.50 for 2028, $7.50 for 2029, and $8.50 (adjusted annually for inflation) on and after 2030—to fund eligible airport-related projects (e.g., development, terminal construction, noise mitigation). (PFCs are local fees collected from enplaned passengers.) The amendments apply to PFCs imposed on or after January 1, 2027, and make conforming changes to remove prior references to the $4.50 cap and strike certain restrictions.
