H.R. 3749 — HER Act

This section directs the Secretary of Health and Human Services, acting through the Director of the National Institute of Environmental Health Sciences, to award grants for research on the impact of personal care products containing endocrine-disrupting chemicals (i.e., chemicals that mimic, blocks, or interfere with hormones) on the female reproductive system and related reproductive toxicity. It requires the Secretary to submit reports to Congress, and make publicly available online, every five years beginning five years after enactment outlining research developments and findings on disparities in access to safe non-endocrine-disrupting personal care products (i.e., cosmetics, as defined in 21 U.S.C. 321, intended for hygiene, grooming, or other personal care), listing safe and harmful such products as determined by the Secretary, and including evidence-based or evidence-informed strategies to expand FDA authority over endocrine-disrupting ingredients harmful to women's reproductive health. The section further directs the Secretary to award grants to states (including the District of Columbia, U.S. territories, and Indian Tribes or Tribal organizations) to investigate such impacts on women's reproductive health and to develop public awareness campaigns on less harmful alternative products, with required reports to Congress every five years beginning five years after initial grant awards summarizing program findings and results.
