H.R. 3817 — Toxic Health Threat Warning Act of 2025

This section requires the Secretary of the Army, acting through the Chief of Engineers, before any planned release of water from a flood risk management structure (i.e., a dam, levee, or similar project operated by the U.S. Army Corps of Engineers), to determine whether the water contains cyanotoxins based on tests conducted by the Secretary, another federal agency, or the relevant state. If cyanotoxins exceed 8 parts per billion, the Secretary must notify the public and affected governments (i.e., state, local, or Tribal governments with jurisdiction over areas impacted by the release) of the determination, planned release, and potential human health effects prior to release.
