H.R. 3855 — To amend title 38, United States Code, to prohibit smoking on the premises of any facility of the Veterans Health Administration, and for other purposes.

This section revises 38 U.S.C. 1715 to prohibit smoking by any person (including veterans, patients, employees, contractors, and visitors) on the premises of any Veterans Health Administration (VHA) facility, replacing prior authority for the Secretary of Veterans Affairs to furnish tobacco to veterans receiving hospital or domiciliary care. It defines smoking to include combustion or heating of tobacco and use of electronic nicotine delivery systems (e.g., e-cigarettes, vape pens) and defines VHA facilities to include land or buildings under VA jurisdiction and VHA control (e.g., medical centers, nursing homes, outpatient clinics, readjustment counseling centers). The section also updates the table of sections for chapter 17 of title 38, United States Code, and repeals section 526 of the Veterans Health Care Act of 1992.
