H.R. 3880 — Clear the ROADS Act

This section establishes a new certification requirement under 23 U.S.C. chapter 1 (§180) under which the Secretary of Transportation withholds 10% of a state's apportionments under 23 U.S.C. §104(b)(1) (National Highway Performance Program) and (2) (Surface Transportation Block Grant Program) unless the state has made reasonable efforts to prohibit non-governmental individuals from knowingly and recklessly obstructing vehicle transportation on federal-aid highways in a manner that endangers public safety or health. Withholding begins on the first October 1 after the Secretary issues regulations or a state holds a legislative session, whichever is later; the Secretary must issue such regulations within 180 days of enactment.
