H.R. 3888 — Water Quality Criteria Development and Transparency Act

This section amends Clean Water Act (CWA) §304(a) by adding paragraph (10) to require the EPA Administrator, after enactment, to issue any new or revised water quality criteria under paragraphs (1) or (9) by rule. (As background, CWA §304(a) criteria reflect the latest scientific knowledge on pollutants' effects on health, welfare, aquatic life, and recreation, which states use to develop water quality standards under CWA §303.) It further amends CWA §509(b)(1) to subject such criteria issuances to judicial review exclusively in courts of appeals within 120 days.
