H.R. 3901 — Jurisdictional Determination Backlog Reduction Act

This section directs the Secretary of the Army, acting through the Chief of Engineers, to eliminate—not later than 60 days after enactment—any backlog as of June 5, 2025, of (1) applications for permits under CWA §404 (33 U.S.C. 1344) (i.e., permits authorizing discharge of dredged or fill material into waters of the U.S., including wetlands), or (2) requests for jurisdictional determinations (i.e., Corps decisions on whether specific areas constitute regulated waters of the U.S.). To achieve this, the Secretary must expedite procedures and reallocate or augment Corps of Engineers personnel and resources as necessary.
