H.R. 3905 — Judicial Review Timeline Clarity Act

This section establishes judicial review procedures for individual permits, general permits, and verifications of activities authorized by general permits under Section 404 of the Clean Water Act (i.e., permits issued by the U.S. Army Corps of Engineers for discharges of dredged or fill material into navigable waters). Specifically, it (1) imposes a 60-day statute of limitations for filing such actions; (2) limits actions to parties that submitted detailed, relevant public comments during the administrative process; (3) requires remand for agency correction of any noncompliance, while generally prohibiting courts from vacating, revoking, enjoining, or limiting permits or activities absent an imminent and substantial danger to human health or the environment with no other equitable remedy; and (4) directs courts to set deadlines of no more than 180 days for agency action following remand. This section also redesignates existing subsection (t) as subsection (u) and designates it as a "savings provision."
