H.R. 3910 — Empowering Parents’ Healthcare Choices Act

This section establishes requirements under the Public Health Service Act, ERISA, and the Internal Revenue Code allowing both parents of a newborn—who are covered under separate health insurance policies or group health plans that would cover the child—to elect primary coverage for the child under one such policy or plan by submitting a joint notification to the issuer or plan within 60 days of birth. The elected primary coverage continues until both parents jointly notify to discontinue it or the electing parent loses coverage; the requirements do not apply if notifications designate multiple policies or plans as primary.
