H.R. 3914 — Valor Has No Expiration Act

This section establishes a new process under 10 U.S.C. §1130a to award military decorations (including devices in lieu thereof), notwithstanding time limitations in 10 U.S.C. §1130, to members of the Army, Navy, Marine Corps, Air Force, or Space Force for active duty service since January 1, 1940, if relevant records were classified, withheld due to sensitivity, or redacted for national security. The Secretary of a military department must begin review of such requests within 30 days of receipt and complete it within one year, using applicable processes under 10 U.S.C. §1130(b)–(c); noncompliance with timelines does not limit award authority, and a Secretary's non-award recommendation does not bind the President. Not later than 30 days after review completion, the Secretary must report to the Senate and House Armed Services Committees (and, for presidentially-awardable decorations, to the President or Secretary of Defense) on the request summary, review findings, final action or recommendation, and any proposed improvements to award procedures for military intelligence personnel.
