H.R. 3929 — GAMBLER Act

This section states congressional findings on the costs and impacts of illegal migration, including (1) the need for bold action to protect communities; (2) average detention costs exceeding $150 per day for 55 days prior to deportation; (3) $4.25 billion appropriated to U.S. Immigration and Customs Enforcement for FY2024 detention and removal operations, deemed insufficient; and (4) projected $177 billion in outlays for benefits to aliens and their children by FY2034. (Thus, costs of apprehension, detention, and deportation should not burden average citizens or require tax increases.)

This section establishes the Border Enforcement Trust Fund in the Treasury of the United States, funded by permanent appropriations equivalent to taxes received under chapter 35 of the Internal Revenue Code (i.e., excise taxes on certain health insurance policies and self-insured plans). Amounts in the fund are available, as provided in appropriation acts, to U.S. Immigration and Customs Enforcement under its operations and support account for enforcement, detention, and removal operations.
