H.R. 3933 — Paving the Way for American Industry Act

This section revises the definition of manufactured product under the Build America, Buy America Act—enacted as part of the Infrastructure Investment and Jobs Act (Public Law 117-58) to require domestic production of iron, steel, manufactured products, and construction materials in certain federally funded infrastructure projects—to specify that yellow organic pigments are included only if all manufacturing processes from initial combination of materials through the chemical reaction resulting in the synthesized pigment (i.e., a process, including biochemical processes, that creates a molecule with a new structure by breaking and forming intramolecular bonds or altering atomic spatial arrangement) occur in the United States. The revision applies to such pigments used in water-based paints for road, highway, or airport surface markings beginning on the date of enactment and to all formulas for such markings containing those pigments beginning two years after enactment.

This section directs the Director of the Office of Management and Budget to update relevant guidance, including implementation guidance of the Made in America Office, not later than 90 days after enactment to reflect the requirements of the amendment made by section 2.
