H.R. 3934 — Water Quality Standards Attainability Act

This section revises state water quality standards review requirements under CWA section 303(c) to (1) require gubernatorial reviews to include any standard applicable to waters receiving municipal combined storm and sanitary sewer overflows pursuant to a permit, order, or decree, with review to ensure cost-effective overflow controls; and (2) add as a factor in such reviews the cost and commercial availability of treatment technologies required for point source compliance with the standards. The section further requires EPA, in developing or revising national water quality criteria under CWA section 304(a), to consider the cost and commercial availability of such point source treatment technologies. (As background, water quality standards specify pollutant limits and designated uses for state waters to protect human health and aquatic life; states must review and submit them to EPA at least triennially.)
