§2.Possession of child porn
This section increases criminal penalties under 18 U.S.C. § 1466A for offenses involving obscene visual depictions—including drawings, cartoons, sculptures, or paintings—of minors engaging in sexually explicit conduct (not requiring an actual minor), or images appearing to depict minors in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse lacking serious literary, artistic, political, or scientific value, as follows: (1) in subsection (a), for production, distribution, receipt, possession with intent to distribute, attempts, or conspiracies, to a fine and punishment by death or life imprisonment (from penalties under 2252A(b)(1), generally 5-20 years imprisonment and up to life with priors); and (2) in subsection (b), for possession, attempts, or conspiracies, to a fine and punishment by death or life imprisonment (from penalties under 2252A(b)(2), generally up to 10 years imprisonment and up to 20 years with priors). This section further revises 18 U.S.C. § 2252(b) to subject violators, attempters, or conspirators of subsection (a)(1)-(4)—transportation, receipt, distribution, or possession of visual depictions of actual minors engaging in sexually explicit conduct—to a fine and punishment by death or life imprisonment (from prior tiered penalties generally mirroring 2252A(b)(1)-(2)). This section also revises 18 U.S.C. § 2252A(b) to subject violators, attempters, or conspirators of subsection (a)(1)-(7)—production, distribution, receipt, possession, access, or pandering of child pornography (including material that is or appears to be of minors)—to a fine and punishment by death or life imprisonment (from prior tiered penalties generally mirroring current 2252A(b)(1)-(2)).
