This section amends the Animal Welfare Act (AWA) to (1) define a "rooster" as any male Gallus domesticus older than 6 months; (2) expand prohibitions in §26(a) (7 U.S.C. 2156(a)) to make it unlawful to knowingly sponsor or exhibit an animal in an animal fighting venture (e.g., cockfighting or dogfighting), attend such a venture, cause an individual under 16 years old to attend, or gamble on any animal fighting venture including in-person or broadcast events; (3) prohibit use of the U.S. Postal Service or interstate instrumentalities to transport roosters; (4) authorize in §26(e) civil citizen suits by any person to enjoin AWA animal fighting violations (with 60-day notice to the Secretary of Agriculture and local law enforcement required beforehand, fines up to $5,000 per violation, limitations if the Secretary or DOJ is already acting, U.S. intervention rights, and awards of litigation costs including attorney fees where appropriate), plus seizure of real property used to commit or facilitate sponsoring or exhibiting animals in such ventures; and (5) make technical corrections clarifying that the AWA does not supersede state/local animal fighting laws absent direct conflict and deeming AWA animal fighting materials nonmailable.
