H.R. 4001 — Prohibition on Funding to CECOT Act

This section states congressional findings concerning human rights issues at the Center for the Confinement of Terrorism (CECOT) maximum security prison in Tecoluca, El Salvador, including (1) documented inhumane conditions, lack of due process, and violations of international standards for the treatment of detainees; and (2) that continued U.S. financial assistance supporting or facilitating CECOT's operation or expansion may contravene U.S. human rights standards.

This section prohibits the appropriation or use of federal funds to support (1) the construction, maintenance, expansion, or operation of the Center for the Confinement of Terrorism maximum security prison (CECOT) in Tecoluca, El Salvador; (2) personnel training, equipment, infrastructure, or services for the CECOT prison; (3) any entity, program, or activity facilitating the CECOT prison's operation or expansion; or (4) costs associated with detaining individuals transported from the United States to the CECOT prison or any other prison in El Salvador, regardless of immigration status. The section also rescinds any unexpended balances of prior federal grants or funds obligated for such purposes.

This section requires the Secretary of State to submit to Congress, not later than 90 days after enactment, a report identifying (1) any funds obligated or expended for purposes described in section 3(a), including funds made available prior to enactment; (2) any contracts, grants, or cooperative agreements in effect that involve support to the CECOT prison, directly or indirectly; and (3) a plan for the reallocation or return of any funds described in section 3(b).
