This section requires U.S. Immigration and Customs Enforcement (ICE) agents conducting enforcement operations in the United States—except as provided in section 3—(1) not to wear facial coverings; and (2) to wear a garment clearly identifying the agent's name and ICE affiliation.
This section establishes exceptions to Section 2 for an agent responding to an imminent threat to life or serious bodily harm or required to wear protective gear for safety or medical purposes. It further requires the agent's supervisor to document and review any such exemption use not later than 48 hours afterward and, if deemed inappropriate, to initiate disciplinary review under Section 4(a).
This section directs the Secretary of Homeland Security to establish procedures ensuring compliance with this Act, including (1) disciplinary review and possible sanctions for any agent who violates the Act and (2) acceptance and review of violation complaints by the Department of Homeland Security's Office for Civil Rights and Civil Liberties. It further requires the Secretary to submit an annual report to Congress detailing any disciplinary actions imposed and complaints received in the previous year, including descriptions of each complaint's review and resulting actions.
This section establishes definitions for terms used in the Act. (1) Terms have the meanings given in section 101 of the Immigration and Nationality Act (8 U.S.C. 1101), except as otherwise provided; (2) "agent" means any employee, officer, or contractor acting under the authority of U.S. Immigration and Customs Enforcement; (3) "enforcement operation" means any enforcement activity under the immigration laws—including an arrest, detention, questioning, raid, or investigation (whether on public or private property)—carried out by an agent; (4) "facial covering" means any mask, garment, helmet, or other item that conceals or obscures the facial identity of an individual (e.g., balaclava, tactical mask, or face-shielding item); (5) "United States" means each of the several States, the District of Columbia, and territories and possessions of the United States.
This section establishes a severability clause, providing that if any provision of the Act, or its application to any person or circumstance, is held invalid, the remainder of the Act and the application of its remaining provisions are unaffected.
