H.R. 4007 — PHARA Act of 2025

This section requires the Secretary of Health and Human Services, acting through the Director of the National Institutes of Health (NIH), immediately after enactment to (1) release and expend all funding required under existing NIH grant and cooperative agreements and fully implement those agreements; (2) pay all pending reimbursement requests under those agreements as rapidly as possible; and (3) prohibit cancellation of any such agreement involving active and ongoing research by an awardee.

This section requires any National Institutes of Health (NIH) grant agreement or cooperative agreement entered into after enactment to include a termination clause permitting termination only for material breach, change in circumstances, or mutual agreement of all parties, provided that (1) the terminating party submits written notice of intent to terminate at least 90 days before termination to all non-terminating parties, and (2) the terminating party attempts to amend the agreement with each non-terminating party before termination.

This section prohibits the National Institutes of Health (NIH) from terminating, in whole or in part, grant agreements or cooperative agreements entered into after enactment on the basis that such agreements no longer effectuate program goals or agency priorities. The section directs the Secretary of Health and Human Services, acting through the NIH Director, to revise 2 CFR 200.340(a)—which currently permits termination of federal awards if a project does not accomplish its goals or if agency priorities change—accordingly.
