H.R. 4033 — Sturgeon Conservation and Sustainability Act of 2025

This section exempts specified captive sturgeon from prohibitions under Section 9(a)(1) of the Endangered Species Act (ESA)—which makes it unlawful to import, export, take, possess, sell, or engage in commercial activities involving endangered fish or wildlife—and from Section 7(a)(2), which requires federal agencies to consult with the Fish and Wildlife Service to ensure their actions are not likely to jeopardize listed species. The exemption applies to (1) farmed sturgeon legally held in captivity or a controlled environment as of enactment until intentionally returned to the wild, and (2) progeny thereof until intentionally returned to the wild. Persons holding such sturgeon must demonstrate qualification and, on request, maintain and submit inventories, documentation, and records as required by the Secretary by regulation (without duplicating other ESA requirements).
