H.R. 4052 — Employment Abundance Act

This section requires the Federal Acquisition Regulatory Council, not later than one year after enactment, to issue regulations requiring Federal contractors subject to the Federal Acquisition Regulation to review job classifications in their Federal contract-related workforce, identify positions requiring a bachelor’s degree or higher, and determine whether such requirements are necessary for essential job functions. The section further requires the Office of Personnel Management, within the same timeframe, to issue regulations requiring each Executive agency (as defined in 5 U.S.C. 105)—i.e., an Executive department, Government corporation, or independent establishment—to conduct parallel reviews of job classifications for appointments and promotions. Not later than 180 days after the effective date of such regulations, contractors must report results to the Federal Acquisition Regulatory Council and agencies to the Office of Personnel Management, including (1) lists of positions where degree requirements lack necessity and (2) plans to revise classifications using alternatives such as relevant work experience, certifications, or skills assessments. The section authorizes enforcement for noncompliance—including contractor ineligibility for future contracts and agency actions under 5 U.S.C. chapter 75—preserves degree requirements shown necessary for job performance or mandated by law, regulation, or licensure, and applies to contracts entered into, and appointments or promotions occurring, on or after the effective dates of the regulations.
