H.R. 4066 — Countering White Supremacist Extremism Act

This section directs the Under Secretary for Intelligence and Analysis of the Department of Homeland Security (DHS), in coordination with federal partners, to develop a terrorism threat assessment and reference aid on threats to the United States from foreign violent white supremacist extremist organizations (i.e., organizations based outside the U.S. that use unlawful acts of force or violence to support white racial superiority). The assessment must (1) incorporate elements of the Department of State Strategy for Countering White Identity Terrorism Globally required under 22 U.S.C. 2656j (which assesses global white identity terrorism threats and outlines State Department coordination and programs to counter them); (2) be developed in coordination with DHS's Office of Civil Rights and Civil Liberties and other agencies; (3) include an overview of symbols, flags, or other references used by such organizations; and (4) exclude names or identifiable information on individuals or organizations engaged in lawful, constitutionally protected political discourse. Consistent with protecting classified and confidential information, DHS must share the assessment with state, local, and tribal law enforcement (including via fusion centers) and, upon request and in consultation with the Office of Civil Rights and Civil Liberties, with online platform operators (i.e., internet services for content storage, processing, and dissemination) to assist in identifying potentially violating content.
