H.R. 4068 — Streamlining NEPA for Coal Act

This section directs the Secretary of the Interior, not later than 30 days after the date of enactment, to identify for the House Committee on Natural Resources and the Senate Committee on Energy and Natural Resources any existing and potential categorical exclusions under the National Environmental Policy Act of 1969 (NEPA) (i.e., categories of proposed actions determined not to have significant environmental effects, thus exempting them from full NEPA review), increased reliance on and adoption of which by other federal agencies pursuant to NEPA §109 (42 U.S.C. 4336c)—which authorizes such adoptions after identification, consultation, public notice, and documentation—could further coal production and export.
