H.R. 4078 — Stop Unlawful Detention and End Mistreatment Act of 2025

This section directs the Secretary of Homeland Security to establish a publicly available online database concerning individuals in the custody of U.S. Immigration and Customs Enforcement (ICE). The database must include, for each such individual, the legal authority and duration of detention, detention location (except for minors, those under protection orders, or witness protection participants), number of transfers, and whether subject to a removal order; for the detained population, demographic data (nationality, age, immigration status), disciplinary actions (including use of force or transfers), and deportations; for each non-traditional detention location (i.e., Department of Defense property, Indian lands, or lands outside the continental United States), the type and location, utilization justification, number of beds, compliance and due process efforts, detention standards (including medical access), timeline and costs, and use agreements; and any open recommendations from the Office of the Immigration Detention Ombudsman, DHS Office for Civil Rights and Civil Liberties, DHS Office of Inspector General, or Government Accountability Office, with implementation timelines or non-adoption rationales. The database must be updated daily, with prior days archived annually, and must exclude personally identifiable information.

This section prohibits the Secretary of Homeland Security from discontinuing or reducing the operation of the Office of the Immigration Detention Ombudsman—which investigates complaints related to conditions in immigration detention facilities—or the Office for Civil Rights and Civil Liberties—which promotes civil rights compliance across DHS activities—subject to the availability of appropriations.
