This section establishes new immigration grounds related to offenses under 18 U.S.C. 659, which criminalizes theft, embezzlement, or fraudulent taking of goods from interstate or foreign shipments by carrier (i.e., from pipelines, vehicles, aircraft, warehouses, or other facilities used by common carriers, with penalties of up to 10 years imprisonment, or 3 years if the value is less than $1,000). Specifically, it (1) adds inadmissibility under INA §212(a)(2)(J) for aliens convicted of, who admit committing, or who admit acts constituting the essential elements of such an offense or a conspiracy to commit it; and (2) adds deportability under INA §237(a)(2)(G) for aliens convicted of such an offense or conspiracy.
