H.R. 4094 — Electronic Consent Accountability Act of 2025

This section states congressional findings that (1) the Government Accountability Office reports federal agencies need to fully implement Office of Management and Budget (OMB) guidance on personal information disclosure; (2) the Creating Advanced Streamlined Electronic Services for Constituents Act of 2019 (CASES Act; P.L. 116-50) required OMB to issue guidance for agencies to accept electronic identity proofing and authentication, create electronic consent templates for agency websites, and accept electronic consent after proper authentication; (3) OMB issued such guidance in memorandum M-21-04 on November 12, 2020; and (4) agencies were instructed to implement by November 2021.

This section requires the heads of 16 specified federal agencies (e.g., Departments of Agriculture, Defense, Health and Human Services, Homeland Security, Justice, and Veterans Affairs; Environmental Protection Agency; Social Security Administration) to submit a report to the House Committee on Oversight and Government Reform, not later than 120 days after enactment of this Act, on whether they have implemented the responsibilities in OMB Memorandum M–21–04 (i.e., modernizing access to and consent for disclosure of records subject to the Privacy Act of 1974). If not implemented, the report must include (1) a justification, (2) a planned timeline for implementation, and (3) steps being taken to implement.
