This section prohibits an abortion provider from causing fetal remains to be placed into a publicly owned water system, with penalties including fines under title 18, United States Code, imprisonment for not more than five years, or both. It exempts from liability the individual upon whom the abortion is performed; does not preempt stricter state or local laws prohibiting the same conduct; and defines "abortion" (a procedure to intentionally kill an unborn child or terminate a pregnancy, excluding procedures intended to produce a live birth, preserve the child's life and health, or remove a dead unborn child), "abortion provider" (the individual performing the abortion, excluding the pregnant individual), "fetal remains" (remains of an aborted fetus or associated medical waste), and "publicly owned water system" (government-owned facilities for providing, transporting, or treating water, including connected drains and pipes).
