H.R. 419 — Protecting America From Spies Act

This section revises the security and related grounds of inadmissibility in INA §212(a)(3)(A) to render inadmissible any alien whom a consular officer, immigration officer, Secretary of Homeland Security, or Attorney General knows or has reasonable ground to believe engages, has engaged, or will engage in specified activities—including (i) espionage or sabotage (or activity that would violate related U.S. laws if conducted in the United States); (ii) violation or evasion of laws prohibiting export of goods, technology, or sensitive information; (iii) any other unlawful activity; or (iv) opposition to, control, or overthrow of the U.S. government by force, violence, or other unlawful means (previously limited to activities the alien would engage in after arrival)—and any such alien's spouse or child if the activity occurred within the last five years. It also amends INA §212(d)(3)(A) to update the list of non-waivable grounds for discretionary admission or parole to include the new subparagraph (A)(iv) (in addition to (A)(i)(I), (A)(ii), (A)(iii), (C), (E)(i), and (E)(ii) of §212(a)(3)).
