This section establishes immunity from suit and liability under federal and state law for any manufacturer of critical infrastructure equipment with respect to claims for loss caused by, arising out of, relating to, or resulting from wildfire incidents, absent proof of willful misconduct in the design or production of such equipment. The section defines critical infrastructure as having the meaning given in section 1016(e) of the USA PATRIOT Act (42 U.S.C. 5195(e))—i.e., systems and assets, whether physical or virtual, so vital to the United States that their incapacitation or destruction would have a debilitating effect on national security, economy, public health or safety, or any combination thereof—and defines manufacturer as those entities within the critical manufacturing sector pursuant to section 2220A(a)(2) of the Cyber Incident Reporting for Critical Infrastructure Act of 2022.
