H.R. 4195 — the Foreign Service Voluntary Early Retirement Authority Act of 2025

This section establishes a new voluntary retirement option under the Foreign Service Retirement and Disability System (22 U.S.C. 4051) for participants (as defined in section 853) not eligible under existing provisions, who are at least 43 years of age (from 50 under current law) with at least 15 years of creditable service (from 20), if separated from the Foreign Service or an agency using its personnel system during a period, as determined by the Office of Personnel Management upon agency request, involving (1) substantial delayering, reorganization, reductions in force, transfer of function, or workforce restructuring; (2) a significant percentage of employees likely to be separated or subject to pay reduction; or (3) surplus or excess positions. (Thus, eligible participants may receive an annuity computed as under 5 U.S.C. 8415(e), i.e., discontinued service retirement under FERS.) The provision applies to separations (involuntary or voluntary) from January 20, 2025, through the date of enactment and to voluntary separations thereafter; provides funding from the Treasury general fund if the Foreign Service Retirement and Disability Fund is inadequate; and expresses a sense of Congress that such annuitants enrolled in the Federal Employees Health Benefits Program retain eligibility.
