H.R. 4207 — No WHO Pandemic Preparedness Treaty Without Senate Approval Act

This section states 12 congressional findings concerning the World Health Organization (WHO), including U.S. withdrawal notifications in 2020 under President Trump (effective July 6, 2021, absent retraction), President Biden's January 20, 2021, retraction, WHO's intergovernmental negotiating body (INB) process to draft a Pandemic Agreement adopted on May 20, 2025, at the 78th World Health Assembly, a Pew survey showing 51% of Americans rated WHO's COVID-19 response as poor or fair, and Department of State criteria for treaties versus executive agreements.

This section expresses the sense of Congress that (1) a significant segment of the American public is skeptical of the World Health Organization (WHO), its leadership, and its independence from political influence by certain member states, including China; (2) any agreement on pandemic prevention, preparedness, and response adopted by the World Health Assembly through the Intergovernmental Negotiating Body (INB) should be a treaty requiring two-thirds Senate concurrence; (3) the agreement's broad scope, as outlined by the WHO Director-General, favors treaty status under the factors in section 2(11); and (4) due to public distrust, the U.S. should not agree to or implement any such agreement lacking that Senate approval.

This section deems any convention, agreement, or other international instrument on pandemic prevention, preparedness, and response adopted by the World Health Assembly (WHA) pursuant to the recommendations, report, or work of the International Negotiating Body (INB)—established by the WHA's second special session—to be a treaty requiring Senate advice and consent by a two-thirds majority, notwithstanding any other provision of law. (Thus, such instruments cannot be implemented as executive agreements.)
