H.R. 4211 — Brownfields Broadband Deployment Act

This section exempts any Federal authorization for a covered project from being considered a major Federal action under sec. 102(2)(C) of the National Environmental Policy Act of 1969 (NEPA; 42 U.S.C. 4332(2)(C)) and exempts such a project from being considered an undertaking under the National Historic Preservation Act (54 U.S.C. 300320). A covered project is the deployment or modification of a communications facility (i.e., as defined in 47 U.S.C. 1455(d)) entirely within a brownfield site (as defined in CERCLA; 42 U.S.C. 9601) that requires a permit, license, approval from, or is otherwise subject to the jurisdiction of, the Federal Communications Commission.
