H.R. 4212 — SHADE Act

This section establishes a grant program, to be administered by the Secretary of Housing and Urban Development (HUD) in coordination with the Secretary of Agriculture acting through the Chief of the Forest Service, under which HUD awards grants to eligible entities—including States, Territories, Tribal agencies, local governments, Indian Tribes (as defined in 25 U.S.C. 5304), and nonprofits partnering with them—for planting qualifying trees (i.e., non-invasive species not unduly threatened by invasives) in eligible areas (i.e., redlined census tracts graded as "hazardous" or "definitely declining" by the Home Owners' Loan Corporation that are currently low-income communities, or intra-urban heat island areas with lower tree canopy and higher summer temperatures than nearby areas). HUD must publish a notice of funding opportunity within 180 days of enactment and establish the program within 180 days of appropriation; grant applications must include a 5-year timeline and budget for planting and maintenance, plus a public participation plan involving residents, nonprofits, and community support; and HUD must prioritize applicants with housing policies minimizing resident displacement. Grant funds may cover project planning and design, tree purchases, site preparation and planting (including labor and equipment), up to 5 years of maintenance and monitoring, training, and other relevant costs, as determined by HUD. The section authorizes $50 million annually for FY2026 through FY2036.
