H.R. 4220 — Gun Violence Prevention Through Financial Intelligence Act

This section directs the Director of FinCEN, within 90 days of enactment and in consultation with the Directors of the FBI and ATF, to promulgate a rule defining, for purposes of the section, "firearm accessory," "homegrown violent extremist," "lone wolf," and "lone actor." It further requires the Director, within one year of enactment, to request information from financial institutions—subject to suspicious activity reporting requirements under 31 USC 5318(g) and tailored to institution size, after consulting the Directors of the FBI and ATF and firearms sellers—for an advisory identifying suspicious activity related to (1) procurement of firearms and accessories by homegrown violent extremists and domestic terrorists (as defined in 18 USC 2331) for lone actor attacks and (2) firearms market exploitation facilitating U.S. gun violence. Within 540 days of enactment, the Director must either issue the advisory if information collected is sufficient or report to the Senate Committee on Banking, Housing, and Urban Affairs and the House Committee on Financial Services on collection details, methodology, response rates, insufficiencies, and barriers.
