H.R. 4224 — Background Check Point of Contact Act of 2025

This section establishes a grant program authorizing the Attorney General to award annual grants of up to $1 million per eligible state conforming to the Act's requirements, renewable annually, to establish, operate, and maintain a point-of-contact system; authorizes $10 million annually for the program; and limits the federal share to 25 percent. The section further directs the Attorney General to give preference, when awarding Bureau of Justice Assistance discretionary grants, to conforming states.

This section requires states to conform their laws to establish or maintain point-of-contact systems for federal firearms licensees (i.e., persons licensed under 18 U.S.C. §923) to verify the lawfulness of firearm sales or transfers, with the following requirements: (1) sales or transfers may not be completed without an approval number issued no later than 10 days after initiation; (2) no approval number may be issued if the system cannot confirm lawfulness; (3) a state-operated hotline to the National Instant Criminal Background Check System (NICS); (4) a state-established fund for system operations; (5) an appeals process for denials with the burden of proof on the state; and (6) transfer of denial information to the responsible state or local law enforcement agency for investigation as a potential violation of law.

This section requires a state receiving a grant under the Act to publish an annual report containing information substantially similar to the FBI's National Instant Criminal Background Check System (NICS) operations report, plus: (1) the number of investigations resulting from failures to issue approval numbers; (2) results of reported investigations; (3) denied appeals that were overturned; (4) total hours the point of contact system was non-functional, halting check processing; and (5) the number of persons arrested as a result of information transfers under section 3(7).

This section establishes definitions for purposes of the Act, including—(1) "firearm," as defined in 18 U.S.C. 921 (i.e., generally, any weapon designed to expel a projectile by explosive action, the frame or receiver of such a weapon, firearm mufflers or silencers, or destructive devices, excluding antique firearms); (2) "law enforcement agency" and "unit of local government," as defined in the Omnibus Crime Control and Safe Streets Act of 1968 (34 U.S.C. 10251); and (3) "State" to include each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and any other territory of the United States.
