H.R. 4251 — Protecting Americans from Reckless Gun Dealers Act of 2025

This section requires the Attorney General to submit to the House and Senate Judiciary Committees, within 180 days of enactment and annually thereafter, a written report on the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) actions in the prior year to inspect, issue, and revoke licenses of federal firearms licensees (FFLs) under 18 U.S.C. §923. The report must detail (1) monthly inspection numbers; (2) inspections identifying at least one serious violation; (3) licenses revoked, not renewed in lieu of revocation, or surrendered post-inspection, including for each such licensee the name, location, date, and serious violations found; (4) inspections with serious violations but no revocation, broken down by reason (e.g., decision not to pursue, hearing reversal, court reversal); (5) reasons not to pursue revocation and violation reports/warning letters/conferences, both geographically by ATF field office; requires ATF to publish each report on its website upon submission; and defines "serious violation" to include 10 specified offenses (e.g., refusing inspection under §923(g), illegal firearm transfers under §922(d) or §922(t)(1), falsifying records under §923(g), or straw purchases under §932). This section also makes a clerical amendment to the table of contents for 18 U.S.C. ch. 44.

This section directs the Comptroller General of the United States to conduct a study on the Bureau of Alcohol, Tobacco, Firearms and Explosives' operations and procedures for issuing, revoking, investigating, and inspecting Federal Firearms Licenses (FFLs) under 18 U.S.C. §923—authorizing businesses to import, manufacture, or deal in firearms and ammunition—with a focus on (1) systemic failures in issuance and revocation contributing to ineffective enforcement of chapter 44 of title 18, United States Code (Gun Control Act of 1968); (2) the Attorney General's discretion not to revoke licenses despite willful violations due to extraordinary circumstances; (3) geographic variability in enforcement; (4) revocation outcomes, including notices not resulting in revocation and average/median times from inspection to revocation (broken down by no hearing/appeal, post-administrative determination without judicial review, and post-judicial review); and (5) oversight policies during revocation proceedings, including judicial review. The Comptroller General must submit a report to Congress on the study results within one year after the date of enactment.
