H.R. 4259 — National Capital Planning Commission District of Columbia Home Rule Act

This section removes the National Capital Planning Commission's (NCPC) review, recommendation, and approval authority over District of Columbia (DC) government actions involving DC-owned property. (As background, the NCPC reviews federal planning, building projects, and land use in the National Capital Region to ensure compatibility with long-term plans.) Specifically, the section (1) limits NCPC recommendations under 40 U.S.C. 8124 to transfers of jurisdiction among federal authorities or between federal and DC authorities (previously required for all such transfers, including among DC authorities) and eliminates the requirement for DC authorities to report transfers to Congress; (2) eliminates NCPC review of DC government proposed developments and projects on federal real property in the DC area under 40 U.S.C. 8722 (previously required alongside federal projects); and (3) repeals 40 U.S.C. 8734, which required NCPC approval before certain sales of federal real property by DC authorities. (Thus, the DC government may now transfer jurisdiction over its property, develop projects, and sell land without NCPC involvement.)
