H.R. 4264 — Stop Trump’s Abuse of Power Act

This section modifies the President's authority under 10 U.S.C. §252 to deploy the Armed Forces domestically to enforce federal laws or suppress rebellion by prohibiting the deployment of a member of a regular component of the Armed Forces serving on active duty within a State or territory of the United States to respond to a peaceful protest or demonstration except upon the request of the governor or chief executive of the State or territory.

This section limits presidential authority under the Insurrection Act (10 U.S.C. 253)—which authorizes deployment of the militia or Armed Forces to suppress insurrection, domestic violence, unlawful combinations, or conspiracies that deprive constitutional rights or obstruct federal laws—by prohibiting deployment of active-duty members of a regular component of the Armed Forces within a state or territory to respond to a peaceful protest or demonstration except upon request of the governor or chief executive.
