H.R. 4333 — Qualified to Serve Act

This section establishes uniform medical accession standards for each armed force that apply equally to all commissioned officers and to all enlisted members across occupational specialties and requires the secretaries concerned to make such standards, including related review processes, readily available to potential recruits. It prohibits disqualifying an individual from service solely based on a medical diagnosis made before age 13 if (1) no treatment was required in the five years preceding accession, (2) a licensed medical professional currently affirms the individual does not meet diagnostic criteria and is fit for service, and (3) the secretary concerned determines the diagnosis is unlikely to affect force health or readiness. It requires the secretaries concerned to establish a process for reviewing medical disqualifications and authorizes waivers of disqualifying diagnoses if determined to be in the national security interest. It requires the Secretary of Defense to submit an annual report to the congressional defense committees identifying (1) the number of persons disqualified due to medical history in the prior calendar year, (2) the number and type of waivers granted under the new waiver authority in the prior year, and (3) any updates to the accession standards or review process since the prior report.
