H.R. 4340 — Tyler’s Law

This section requires hospitals and medical examiner or coroner offices to submit written reports to the Consumer Product Safety Commission (CPSC) within 7 days of determination for incidents involving the death or serious injury (for hospitals) or death (for medical examiner or coroner offices) of a child under age 18 associated with a children's product (i.e., consumer product designed or intended primarily for children 12 years of age or younger) or durable infant or toddler product (i.e., products such as cribs, carriers, and high chairs subject to CPSC safety standards). (1) Hospitals must report incident details (e.g., date, location, child demographics, diagnoses, product code from CPSC's NEISS system), treatment provided, and factors such as alcohol or fire; compliance is added as a Medicare condition of participation under the Social Security Act. (2) Medical examiner or coroner offices must report similar details including cause of death; noncompliance results in ineligibility for Department of Justice Medical Examiner-Coroner System Program grants the following fiscal year. The requirements apply to incidents occurring on or after 180 days after enactment.
