H.R. 4369 — End Tenant Credit Screening Act

This section prohibits any person, including a housing provider (i.e., any person leasing residential real estate), from using a consumer report or investigative consumer report—or causing such a report to be procured—for tenant screening purposes (i.e., evaluating a consumer for rental housing, including application approval, security deposit or lease terms, or tenant retention) if the report contains information on the consumer's creditworthiness, credit standing, or credit capacity. The prohibition applies regardless of consumer consent, except for reports provided for reconsideration of a denial (i.e., an individualized reconsideration of a previously rejected rental application after bona fide consideration).
