H.R. 4376 — AV Safety Data Act

This section directs the Administrator of the National Highway Traffic Safety Administration (NHTSA) to promulgate, not later than 90 days after enactment, regulations requiring each covered entity (i.e., a manufacturer or operator subject to NHTSA's Third Amended Standing General Order 2021-01 on incident reporting for automated driving systems and Level 2 advanced driver assistance systems) to submit (1) information required by that order and (2) a monthly report for the preceding month that includes the number of miles traveled on public roads by covered vehicles (i.e., those with an automated driving system or Level 2 advanced driver assistance system), disaggregated by make, model, model year, major software version, road type, location, and occupant presence; information on collisions involving such vehicles that injured a vulnerable road user (i.e., as defined in 23 U.S.C. §148(a), such as pedestrians or cyclists) or an occupant of another vehicle; and detailed information on any unplanned stoppage event (i.e., a stop on a public road travel lane without retrieval or intervention, or interference with transit, responders, or work zones, excluding intentional human-caused collisions), including vehicle identifiers, event circumstances, environmental factors, impacts, resolutions, interventions, and durations. For Level 2 advanced driver assistance system vehicles, monthly report data is limited to periods when the system was engaged or the 30 seconds preceding an unplanned stoppage and excludes personally identifiable information on human drivers. This section further requires NHTSA, beginning 120 days after enactment, to make all submitted information publicly available on its website in machine-readable format, including datasets; permits NHTSA after 10 years to rescind or reduce the regulations' frequency or scope (while allowing consistent amendments at any time); and defines key terms.
