H.R. 4397 — Muslim Brotherhood Terrorist Designation Act of 2025

This section amends the Anti-Terrorism Act of 1987 (22 U.S.C. 5201 et seq.) to (1) add congressional findings designating the Muslim Brotherhood and its affiliates as terrorist organizations alongside the Palestine Liberation Organization (PLO) and its affiliates, citing Hamas as a Muslim Brotherhood branch designated as a foreign terrorist organization, the October 7, 2023, Hamas attack affecting U.S. citizens, and the Muslim Brotherhood's support for branches outlawed as terrorist groups by certain U.S. allies; (2) extend prohibitions on receiving funds or things of value from, or establishing or operating offices or facilities in the United States for, the PLO to also cover the Muslim Brotherhood and their affiliates; (3) limit termination of such prohibitions to those regarding the PLO; and (4) require the Secretary of State to impose visa ineligibility, admission, parole, and revocation sanctions under section 306(b)(1) of the Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act (22 U.S.C. 1741d(b)(1)) on any foreign person determined to be a Muslim Brotherhood member. (As background, the referenced sanctions render affected aliens inadmissible to the United States, ineligible for visas or entry documentation, and subject to immediate visa revocation.) It also adds definitions, including "Muslim Brotherhood," "Muslim Brotherhood branch" (e.g., Hamas and Lajnat al-Daawa al-Islamiya, or any affiliate in specified countries such as Egypt, Qatar, and the United Arab Emirates), and "Muslim Brotherhood member."

This section defines terms related to the Muslim Brotherhood and requires the Secretary of State to submit to the relevant congressional committees (i.e., Senate Committee on Foreign Relations, House Committee on Foreign Affairs, and House Committee on the Judiciary) an initial report within 90 days of enactment—and annually thereafter—identifying all Muslim Brotherhood branches (including those in specified countries and jurisdictions) and determining, for each, whether it has been designated as a foreign terrorist organization (FTO) under section 219(a) of the Immigration and Nationality Act (8 U.S.C. 1189(a)) or as a specially designated global terrorist (SDGT) under Executive Order 13224 (relating to blocking property of terrorists), or whether its activities meet criteria or constitute grounds for such designation. It further requires the President to impose FTO or SDGT sanctions on the Muslim Brotherhood (or any successor organization) within 90 days of enactment; to impose FTO designation on any such branch already designated as an SDGT (or vice versa) and SDGT sanctions on any meeting relevant criteria within 30 days of each report; and to maintain those sanctions for a minimum of four years from the relevant report date. (FTO designation prohibits material support and renders members inadmissible; SDGT designation blocks U.S. property and transactions under International Emergency Economic Powers Act authorities.)
