This section prohibits the Office of Personnel Management (OPM) from contracting with Federal Employees Health Benefits (FEHB) qualified carriers that directly or indirectly own, operate, control, or direct pharmacies or pharmacy benefit managers (PBMs), or that are owned, operated, or directed by PBMs. It further prohibits OPM or such carriers from contracting or subcontracting with PBMs that own, operate, control, or direct pharmacies. The section provides definitions—including for "person" (as under the Sherman Act, 15 U.S.C. 7), "pharmacy" (covering retail, mail-order, specialty, hospital, and other licensed entities), "PBM," "health plan," and "qualified carrier"—and states that it does not limit enforcement authority of the Federal Trade Commission, Department of Justice Inspector General, Department of Health and Human Services, or state attorneys general.
