H.R. 4413 — End the Cyprus Embargo Act

This section expresses the sense of Congress that (1) allowing the export, re-export, or transfer of arms on the United States Munitions List to the Republic of Cyprus would advance U.S. security interests in Europe by reducing Cyprus's dependence on countries that challenge U.S. interests for defense materiel; (2) Cyprus has complied with conditions in the Eastern Mediterranean Security and Energy Partnership Act of 2019 (title X of division J of Public Law 116-94) to modify prohibitions on defense article and service sales and the policy of denial for such Munitions List items; and (3) it is in the U.S. interest to support United Nations efforts for a Cyprus solution, enhance the U.S.-Cyprus security partnership under that Act, promote U.S. Armed Forces cooperation with the Cyprus National Guard (including joint training with the New Jersey National Guard under the Department of Defense State Partnership Program), and encourage Cyprus to join NATO's Partnership for Peace program.

This section directs the Secretary of State, beginning on the date of enactment, not to apply the policy of denial (i.e., a longstanding restriction on U.S. arms exports to Cyprus due to tensions with Turkey) for exports, re-exports, or transfers of defense articles and services destined for or originating in the Republic of Cyprus if requested by or on behalf of its government and the end-user is that government. The exclusion does not apply to denials based on credible human rights concerns; the President may waive it for one fiscal year if essential to U.S. national security interests; and the President may terminate it (and renew such termination) for successive 5-year periods upon certifying to the House and Senate Foreign Affairs/Foreign Relations and Armed Services Committees that Cyprus is no longer cooperating with the United States on anti-money laundering reforms and port access denials for Russian military vessels.
