H.R. 4476 — Preventing Authoritarian Policing Tactics on America’s Streets Act

This section establishes definitions for this provision, including "Federal law enforcement officer" (i.e., authorized executive, legislative, or judicial branch personnel or contractors performing law enforcement functions such as prevention, detection, investigation, prosecution, or incarceration of law violations) and "member of an armed force." It requires such officers and members engaged in crowd control, riot control, or arrest or detainment of individuals during civil disobedience, demonstrations, protests, or riots in the U.S. to display identifying information (Federal agency and last name/unique identifier, or rank for armed forces members) clearly at all times; prohibits taping over or obscuring such information or using unmarked vehicles for apprehensions, detentions, or arrests; and limits these activities to Federal property or its immediate vicinity (i.e., adjacent sidewalk and public street) unless a state governor and local government head jointly request assistance in writing or the Insurrection Act (10 U.S.C. ch. 13) is invoked. It makes arrests by such officers or members unlawful if identification or location limits are violated. It requires the deploying agency or armed force to publish public notice on its website within 24 hours of deployment, including deployment date, number of personnel per city/town/locality, mission description, detainee locations and custody, and any written assistance request.
