H.R. 4483 — State Accountability for Federal Deployment Costs Act of 2025

This section states congressional findings that (1) immigration enforcement is a federal power; (2) certain states and localities have refused to assist or have obstructed federal immigration enforcement, including by ignoring detainer requests; (3) such obstruction can cause civil unrest or law enforcement emergencies requiring National Guard deployments under 10 U.S.C. §12406 (i.e., presidential orders federalizing the National Guard to repel invasion, suppress rebellion, or execute laws) or active-duty forces; and (4) the Department of Defense and taxpayer costs from such deployments should be reimbursed by the responsible states and localities.

This section requires the Secretary of Defense to submit a reimbursement invoice to the governor of an affected state for specified costs whenever federal military personnel (including National Guard and Selected Reserve units) are deployed under federal authority to a jurisdiction due to civil disturbances stemming from lawful federal immigration enforcement operations and the failure of the state or a unit of local government to provide reasonable cooperation or coordination with such operations. Reimbursable costs include (1) temporary duty travel and per diem, (2) housing, lodging, and meals, and (3) transportation of such personnel and equipment. The Secretary of Homeland Security, in consultation with the Attorney General, must issue a public determination of noncooperation by the state or local government. States must remit full payment within 180 days of receiving an invoice, or the President—after consultation with specified officials—may rescind one or more of the state's discretionary federal grants to offset the nonpayment.
