H.R. 4487 — Gun Safety Incentive Act

This section directs the Attorney General, not later than 180 days after enactment and following at least 90 days public notice and opportunity for hearings, to establish voluntary best practices for safe firearm storage solely for public education purposes. Those best practices must outline measures to prevent firearm loss, theft, and unauthorized access at (1) businesses, (2) vehicles, (3) private homes, (4) off-site storage facilities, and (5) other locations deemed appropriate; the Attorney General must publish them in print and on a public website not later than one year after enactment and review and update them annually.

This section requires licensed manufacturers and licensed importers that serialize not less than 250 firearms annually pursuant to 18 U.S.C. 923(i) to provide a clear and conspicuous written notice—with each manufactured or imported handgun, rifle, or shotgun beginning January 1, 2027—that is attached to or appears on the firearm's packaging and states “SAFE STORAGE SAVES LIVES” followed by the address of the public website established by the Attorney General pursuant to section 2 of the Kimberly Vaughan Firearm Safe Storage Act.

This section expands the requirement for licensed firearms importers, manufacturers, and dealers to provide a secure gun storage or safety device with each handgun transferred to a non-licensee (i.e., private buyer not a licensed dealer or government officer) to also include rifles and shotguns, effective 180 days after enactment.

This section establishes a grant program administered by the Attorney General to award funds to states and Indian tribes for the development, implementation, and evaluation of Safe Firearm Storage Assistance Programs, which are local government or tribal initiatives to acquire and distribute safe firearm storage devices (i.e., locks or devices that deny unauthorized access to firearms or ammunition). Grantees must apply with details on supplemental funding sources; use at least 75% of funds for such programs in their jurisdiction and up to 25% for nonprofits partnering with local governments; and submit annual reports to the Attorney General on amounts distributed and devices provided (without personally identifiable information). The Attorney General must report annually to Congress beginning 13 months after the first grants are awarded, including grantee lists, awards, and program data. The section authorizes $10 million annually for FY2027 through FY2035, to remain available until expended.

This section establishes a safe firearm storage credit under the general business credit equal to 10% of amounts received from the first retail sale of a qualifying safe firearm storage device for use in the United States, not to exceed $400 per device. A qualifying device is designed and marketed to deny unauthorized access to or render inoperable a firearm or ammunition (as defined in 18 U.S.C. §921, excluding destructive devices), is secured by a combination, key, or biometric lock, and is neither incorporated into a firearm or ammunition nor subject to a Consumer Product Safety Commission recall. The credit terminates for sales after December 31, 2032; requires the Secretary of the Treasury to issue an annual public report of credits claimed by state; and applies to taxable years beginning after enactment.

This section establishes a severability clause providing that the invalidation of any provision of the Act, an amendment made by the Act, or its application to any person or circumstance does not affect the remainder of the Act, its amendments, or their applications to other persons or circumstances.
