H.R. 4499 — To make technical amendments to update statutory references to provisions reclassified to title 34, United States Code, and to correct related technical errors.

(Thus, these changes ensure continued application of VAWA definitions—such as for abuse in later life, child maltreatment, and community-based organizations—to immigration benefits for victims of domestic violence, sexual assault, and related crimes.)

This section updates statutory cross-references to reflect the recodification of certain criminal justice laws from title 42 to title 34, United States Code, as follows: (1) in a note to 10 U.S.C. 951 concerning Sex Offender Registration and Notification Act requirements, inserts citation to 34 U.S.C. 20901 et seq.; (2) in 10 U.S.C. 1565 (requiring DNA sample collection from armed forces members convicted of qualifying military offenses for inclusion in the Combined DNA Index System), revises citations including to 34 U.S.C. 40702(a), 40702(d), 40702, and 40703 (from prior 42 U.S.C. 14135a(d) references) and to 34 U.S.C. 12592(a); (3) in a note to 10 U.S.C. 1787 (military family advocacy program requirements for reporting child abuse crimes), revises citations to 34 U.S.C. 20341(b) and (c) (from 42 U.S.C. 13031(b) and (c)); and (4) in 10 U.S.C. 2696(f)(1)(C) (Department of Defense participation in justice assistance grant programs), revises citation to 34 U.S.C. 10171 (from 42 U.S.C. 3762a).

This section updates statutory citations in higher education and elementary and secondary education laws to reflect recodification of certain criminal justice provisions in title 34, U.S. Code, as follows: (1) in the Clery Act (20 U.S.C. 1092(f)), (A) replaces the citation to the Violence Against Women Act from 42 U.S.C. 13925(a) to 34 U.S.C. 12291(a), and (B) adds a citation to the Hate Crime Statistics Act (34 U.S.C. 41305, 41305 note) and replaces the Violence Against Women Act citation from 42 U.S.C. 13925(a) to 34 U.S.C. 12291(a); (2) in the Safe Schools Act of 1994 (20 U.S.C. 5964(a)(9)), adds a citation to the Juvenile Justice and Delinquency Prevention Act of 1974 (34 U.S.C. 11101 et seq.); and (3)-(5) in specified provisions of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6434(c)(19), 6453(10), and 6455(10)), replaces or adds citations to the Juvenile Justice and Delinquency Prevention Act of 1974 from 42 U.S.C. 5601 et seq. to 34 U.S.C. 11101 et seq.

This section makes technical amendments to 22 U.S.C. 212b, which requires the Secretary of State to place unique identifiers on passports issued to covered sex offenders (i.e., individuals required to register under U.S. sex offender registration laws who receive notifications from the Angel Watch Center), by inserting U.S. Code citations—(1) 34 U.S.C. 21507 after references to section 9 of the International Megan's Law to Prevent Child Exploitation and Other Sexual Crimes Through Advanced Notification of Traveling Sex Offenders in subsections (a), (b)(2), and (f); and (2) 34 U.S.C. 21503(f) after a reference to section 4(f) of that law in subsection (c)(1)(A). This section updates statutory citations in the Indian Alcohol and Substance Abuse Prevention and Treatment Act of 1986 and the Indian Law Enforcement Reform Act as follows: (1) inserts "(34 U.S.C. 11101 et seq.)" after each reference to the Juvenile Justice and Delinquency Prevention Act of 1974 in 25 U.S.C. 2433(b)(1), 2453(a)(2), and 2454; and (2) replaces the citation in 25 U.S.C. 2802(c)(14) with "(34 U.S.C. 10132(g))" (from "(42 U.S.C. 3732)").
